These Terms of Service ("Terms") govern your use of the Breathing Zone mobile application (the "App") published by Breathing Zone Ltd ("we," "us," or "our"). By installing or using the App you agree to these Terms.
Breathing Zone is a guided breathing application intended for general wellness and relaxation. You may use the App for personal, non-commercial purposes in accordance with these Terms and the rules of the App Store or Google Play.
Breathing Zone is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is not a substitute for professional medical care. If you have a medical condition, consult a qualified healthcare provider before using guided breathing exercises. If you experience dizziness, shortness of breath, or any adverse reaction while using the App, stop immediately.
Some features may require an in-app purchase. Purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their respective terms. Refunds for in-app purchases are handled by the App Store or Google Play under their refund policies.
The App, including all content, design, code, audio, and trademarks, is owned by Breathing Zone Ltd or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App except as expressly permitted by law.
The App is provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.
To the maximum extent permitted by law, Breathing Zone Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the App.
We may suspend or terminate your access to the App at any time if you breach these Terms. You may stop using the App at any time by uninstalling it.
We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms at this URL and updating the Effective Date above. Continued use of the App after a change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of New Zealand. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
